4. AI and Intelligent Processing

4.1 How ThetaSync Processes Your Data

ThetaSync uses intelligent processing services (including OpenAI and ElevenLabs) to:

Analyze your onboarding responses to create identity insights
Generate personalized transformation scripts
Convert text to speech for audio programs
Process voice samples for voice cloning
Provide insights on your journal entries and reflections
Extract and analyze limiting beliefs from your scripts, reflections, and onboarding data
Generate belief refinement questions and process your responses to personalize belief transformation
Create AI-guided visualization prompts based on your script content

4.2 Data Sent to Processing Providers

When using these features, relevant portions of your content are sent to third-party providers for processing. These providers are bound by their own privacy policies and data processing agreements.

4.3 Voice Data Processing

Voice samples submitted for voice cloning are processed by ElevenLabs. By submitting a voice sample, you confirm that you have the legal right to use that voice (your own voice or a voice for which you have obtained explicit consent from the speaker). Voice data may be retained by the processing provider in accordance with their privacy policy.

4.4 Health Data

When you connect a health provider (such as Apple Health or Google Fit), ThetaSync accesses sleep quality and mindful minutes data solely to correlate your wellbeing metrics with your listening habits. This data is stored on our servers and is not shared with third-party AI processing providers. You can disconnect health integration at any time through the App settings, and previously synced health data will be deleted upon request.

Our marketing website uses localStorage to store your cookie consent preference. When you accept cookies, we collect:

Landing Page: You can decline cookies via the consent banner on first visit. If declined, no analytics data is collected.

Declining analytics does not affect your ability to use the App or any of its features.

8.3 Right to Erasure

You can delete your account and all associated data directly from the App by going to Settings > Delete Account. You may also request deletion by contacting us at support@lifemastri.com.

8.4 Right to Data Portability

You may request a machine-readable copy of your personal data by contacting us at support@lifemastri.com.

8.5 Right to Restrict Processing

You can restrict certain data processing by disabling analytics tracking in Settings, or by contacting us to request limitations on how we process your data.

8.6 Right to Object

You have the right to object to processing of your personal data for direct marketing or analytics purposes. Use the in-app analytics toggle or contact us.

8.7 Right to Withdraw Consent

Where processing is based on your consent, you can withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.

You can opt out of promotional communications through the App settings or by contacting us.

8.9 Exercising Your Rights

9. Age Requirements and Children's Privacy

The App is intended for users aged 13 and older. Users between 13 and 18 must have parental or guardian consent to use the App.

We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us immediately at support@lifemastri.com, and we will take steps to delete that information.

If you are a California resident, you have additional rights under the California Consumer Privacy Act:

If you are a Maryland resident, you have additional rights under the Maryland Online Data Privacy Act:

Sensitive Data

We recognize that certain categories of data we collect are considered "sensitive data" under Maryland law, including:

Voice recordings (biometric data): Used for voice cloning and voice reflections
Health data: Sleep quality and mindful minutes from connected health providers

We collect and process sensitive data only with your explicit, affirmative consent. Voice recordings are only collected when you actively initiate a recording. Health data is only accessed when you voluntarily connect a health provider in Settings. You may withdraw consent for sensitive data processing at any time by disconnecting health integration or deleting voice clones through the App.

Data Minimization

We collect only the data reasonably necessary to provide our services. Each category of data we collect maps directly to a specific service function:

Account information: To create and manage your account
Onboarding responses: To generate personalized scripts
Voice recordings: To provide voice cloning and voice reflection features you initiate
Usage data: To improve app performance and your experience
Health data: To correlate wellbeing metrics with listening habits (opt-in only)

Your Maryland Rights

In addition to the rights described in Section 8, Maryland residents have the right to:

Universal Opt-Out Signals

We recognize and honor universal opt-out preference signals (such as Global Privacy Control) where required by applicable law. If we detect such a signal from your browser or device, we will treat it as a valid opt-out request for the sale or sharing of personal information. Since we do not sell or share personal information for targeted advertising, this signal serves as confirmation of your preferences.

11. International Users

If you access the App from outside the United States, your information will be transferred to and processed in the United States. By using the App, you consent to this transfer.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Life Mastri LLC ("Company," "we," "us," or "our") regarding your access to and use of the ThetaSync mobile application ("App") and related services.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years of age to use this App. If you are between 13 and 18 years of age, you must have permission from a parent or legal guardian to use this App, and your parent or guardian must agree to these Terms on your behalf.

By using this App, you represent and warrant that you meet these eligibility requirements.

3. Description of Service

ThetaSync is a personal development application that provides:

Intelligent identity analysis and transformation scripts
Personalized audio programs with binaural beats and ambient sounds
Voice cloning and text-to-speech audio generation
Journaling and reflection tools
AI-powered belief extraction, refinement, and script matching
Guided breathwork sessions with customizable patterns

The App is designed for personal growth and self-improvement purposes only.

4. Account Registration

To access certain features of the App, you may need to create an account. You agree to:

Provide accurate, current, and complete information
Maintain the security of your password and account
Promptly update your account information as needed
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use

5. Subscription and Payments

5.1 Subscription Plans

6. User Content

6.1 Your Content

You retain ownership of any content you submit through the App, including journal entries, reflections, custom scripts, voice recordings, and belief inventory entries. By submitting content, you grant us a non-exclusive license to use, process, and store your content solely to provide and improve our services.

6.2 Responsibility for Content

You are solely responsible for all content you create, upload, or submit through the App. This includes custom scripts, journal entries, reflections, and any text you enter. We do not monitor or pre-screen user-generated content and are not liable for any content you create.

6.3 Prohibited Content

You agree not to submit content that:

Is illegal, harmful, threatening, abusive, or harassing
Promotes violence, self-harm, or harm to others
Violates any third party's rights, including intellectual property or privacy rights
Contains malware or harmful code
Misrepresents your identity
Is intended to manipulate, deceive, or harm another person

7. Voice Cloning

7.1 Consent Requirement

The App allows you to clone voices for use in personalized audio programs. By using the voice cloning feature, you represent and warrant that:

You have the legal right to use any voice sample you submit
If the voice belongs to another person, you have obtained their explicit, informed consent
You will not use cloned voices for deception, impersonation, fraud, or any unlawful purpose

7.2 Prohibited Voice Cloning Uses

You agree not to use the voice cloning feature to:

Clone the voice of any person without their explicit consent
Create audio that impersonates another person for deceptive purposes
Generate content that is defamatory, harassing, or threatening
Produce content that violates any applicable law or regulation

7.3 Liability

You are solely responsible for ensuring you have proper authorization for any voice you clone. Life Mastri LLC is not responsible for any unauthorized use of the voice cloning feature.

8. Intelligent Content Generation

8.1 AI-Generated Content

The App uses artificial intelligence services, including OpenAI and ElevenLabs, to generate personalized content such as transformation scripts, identity analysis, belief refinement, visualization prompts, and audio narration. You acknowledge that:

Generated content is for personal development purposes only
Generated content should not replace professional medical, psychological, or therapeutic advice
Results may vary and are not guaranteed
We do not guarantee the accuracy, completeness, or appropriateness of generated content
You are responsible for reviewing any generated content before use

8.2 AI-Generated Content Ownership

Scripts, analysis, and other text content generated by the App for your personal use are licensed to you for personal, non-commercial purposes. Audio content generated using AI voice synthesis is licensed to you for personal use within the App. You may not extract, resell, redistribute, or commercially exploit AI-generated content outside the App without our prior written consent.

8.3 Third-Party Voice Synthesis

The App uses ElevenLabs, a third-party voice synthesis provider, to generate audio narration for your scripts and content. By using audio features, you acknowledge that:

Your script text is transmitted to ElevenLabs for voice synthesis processing
ElevenLabs processes this data in accordance with their own privacy policy and terms of service
Voice preset selections in the App use stock voices licensed from ElevenLabs for commercial use
The quality, tone, and characteristics of generated audio are subject to ElevenLabs' technology and may vary

8.4 AI-Generated Images

The App may use AI image generation services to create visual content. Any AI-generated images displayed within the App are owned by Life Mastri LLC and may not be extracted, reproduced, or used outside the App without our prior written consent.

8.5 Analytics and Data Collection

By accepting these Terms, you consent to the collection of anonymized usage analytics to help us improve the App. All personally identifiable information (PII) is stripped before analytics data is stored or processed. Analytics data includes screen views, feature usage frequency, audio playback metrics, and session duration. No personal content (journal entries, scripts, reflections, or voice recordings) is included in analytics. You may opt out of analytics collection at any time via Settings > Usage Analytics without affecting your ability to use the App.

9. Health and Safety Disclaimers

9.1 Not Medical or Therapeutic Advice

THE APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL, PSYCHOLOGICAL, OR THERAPEUTIC ADVICE, DIAGNOSIS, OR TREATMENT. The App is intended for general personal development and self-improvement only.

Always seek the advice of qualified health providers with questions regarding any medical or mental health condition. Never disregard professional advice or delay seeking it because of content provided by the App.

9.2 Binaural Beats Safety

The App generates binaural beat audio at various frequencies. Binaural beats involve audio stimulation that may affect brainwave patterns. You acknowledge the following:

Seizure Risk: Individuals with epilepsy or a history of seizures should consult a physician before using binaural beats. Audio-frequency stimulation may trigger seizures in susceptible individuals.
Not While Driving: Do not listen to binaural beats while driving, operating heavy machinery, or performing any activity that requires full alertness.
Discontinue If Uncomfortable: If you experience dizziness, nausea, headaches, or any discomfort while listening to binaural beats, stop immediately.
Volume Safety: Listen at a comfortable volume. Prolonged exposure to loud audio can damage hearing.

9.3 Breathwork Safety

The App includes guided breathing exercises. You acknowledge the following:

Medical Conditions: Individuals with respiratory conditions, cardiovascular issues, or who are pregnant should consult a physician before using breathwork features.
Discontinue If Uncomfortable: If you experience lightheadedness, tingling, or any discomfort during a breathing exercise, stop immediately and breathe normally.
Not While Driving: Do not practice breathwork while driving, operating machinery, or performing activities that require full attention.

9.4 No Guaranteed Results

ThetaSync is a tool for personal exploration and self-improvement. We make no claims or guarantees regarding specific outcomes, behavioral changes, or life improvements. Individual experiences and results will vary.

9.5 Mental Health

If you are experiencing a mental health crisis, please contact a licensed mental health professional or call emergency services. The App is not a substitute for professional mental health care.

10. Intellectual Property

10.1 Our Property

The App, including its design, features, and content (excluding your personal content), is owned by Life Mastri LLC and protected by intellectual property laws.

10.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

10.3 Generated Content

Scripts and audio generated by ThetaSync for your personal use are licensed to you for personal, non-commercial purposes. You may not resell, redistribute, or commercially exploit generated content.

10A. Content Rights

10A.1 App Media and Content

All media content within the App — including ambient soundscapes, music tracks, breathwork audio cues, binaural beat tones, app icons, illustrations, and UI assets — is either:

Created originally by or for Life Mastri LLC
Generated using properly licensed AI content creation tools
Licensed from third-party providers under commercial licenses that permit use in mobile applications
Used under open-source licenses that permit free commercial use (e.g., SIL Open Font License, MIT License)

Life Mastri LLC represents and warrants that it has obtained proper rights, licenses, or permissions for all third-party content displayed or distributed within the App.

The App incorporates services and content from the following third-party providers:

10A.3 User Content in Community Features

When you share content in ThetaSync's community features (posts, comments, shared progress), you grant Life Mastri LLC and other ThetaSync users a non-exclusive, royalty-free license to view, display, and interact with that content within the App. You retain full ownership of your community content and may delete it at any time. Content shared in community features is subject to our content moderation policies and may be reviewed for compliance with community guidelines.

11. Prohibited Uses

You agree not to:

Copy, modify, or distribute the App or its content
Reverse engineer or attempt to extract source code
Use the App for commercial purposes without authorization
Interfere with or disrupt the App's functionality
Use automated systems or bots to access the App
Attempt to gain unauthorized access to other users' accounts or data
Use the App to generate content intended to harm, harass, or deceive others
Resell, sublicense, or redistribute generated scripts or audio
Use the App in any way that violates applicable laws or regulations
Misrepresent the App's generated content as professional advice

12. Disclaimers

12.1 As-Is Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.2 Service Availability

We do not guarantee that the App will be available at all times or free from errors or interruptions.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIFE MASTRI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM:

Your use of or inability to use the App
Any content generated by the App
Any voice cloning activities conducted through the App
Any reliance on binaural beats or audio content
Unauthorized access to or alteration of your data

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Life Mastri LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any third party's rights
Content you create or submit through the App
Your use of the voice cloning feature

15. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.

We may also terminate your account if we believe you are:

Under 13 years of age
Using the App in violation of these Terms
Engaging in fraudulent or harmful activity

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date and, where appropriate, through in-app notifications. Your continued use of the App after changes constitutes acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to conflict of law principles.

18. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may bring claims in small claims court if eligible.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Life Mastri LLC regarding the App.
